USE OF PERSEPTION WEBSITE

By using www.perseption.com and the www.perseption.com mobile application you represent and warrant that you are more than 18 years of age or are visiting www.perseption.com with the permission and supervision of a parent or guardian. Subject to these Terms and Conditions, Perseption hereby grants you a limited, revocable, non-exclusive license to access and use the www.perseption.com website on your computer or mobile device. Except as permitted in this paragraph, you may not reproduce, modify, display or otherwise make commercial use of any content from the Perseption website unless expressly permitted by Perseption. Perseption  reserves the right to refuse service to any individual at its sole discretion and without limitation if it believes that a user’s conduct violates applicable laws or is otherwise harmful to www.perseption.com

USER-REVIEWS, PHOTOS & COMMENTS

Anything posted or otherwise submitted to Perseption whether on the www.perseption.com website, through a mobile application, blog or via any form of social media (including by submitting an image to your social media using a Perseption.la branded hashtag), will be treated as public and nonproprietary. By submitting photographs, comments or other materials to Perseption, you grant Perseption a royalty-free, worldwide, perpetual, irrevocable and transferable right to use, copy, distribute, publish and modify such submissions. All such submissions shall automatically become Perseption ’s sole and exclusive property. In addition, when you post photographs, reviews or comments to Perseption or on any of Perseption ’s social media networks, you also grant us the right to use the name that you submit, if any, in connection with that submission. You further represent and warrant that you own or otherwise control all rights to any content submitted to Perseption.

 

INTELLECTUAL PROPERTY RIGHTS

All graphics, images and content on the www.perseption.com website, blog and mobile application belong exclusively to Perseption or its affiliates. The use of any Perseption trademarks or service marks without Perseption’s express written consent is strictly prohibited. You may not use Perseption’s trademarks or service marks in connection with any product or service that is in any way likely to cause confusion or to disparage or discredit Perseption.la . In addition, you may not use any of Perseption’s trademarks or service marks in meta tags without Perseption’s explicit prior consent.

INTERNATIONAL ACCESS

Customers who access and use the www.perseption.com website from outside of the United States are responsible for complying with their local laws and regulations. Occasionally a vendor requests that Perseption  restrict the sale of their brand to certain countries. Though Perseption  prefers not to limit the brands Perseption sells, Perseption must honor its vendor’s wishes. However, Perseption continually reviews such restrictions with its vendors to see if any changes can be made. You will be alerted at checkout if an item in your cart is restricted from shipping to your country. If you put a restricted item in your cart, you will not be able to check out until that item is removed from your cart or you change your shipping address.

SMS MARKETING

By consenting to PERSEPTION’s SMS marketing, you agree to receive recurring text notifications, text marketing offers, and transactional texts, including requests for reviews from us, even if your mobile number is registered on any state or federal do-not-call list. Message frequency varies. Consent is not a condition of purchase.
If you wish to unsubscribe from receiving text marketing messages and notifications, reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you within any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests, will not be considered a reasonable means of opting out. We do not charge for the service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

We have the right to modify any telephone number or short code we use to operate the service at any time. You will be notified on such occasions. You agree that any messages you send to a telephone number or short code we have changed, including any STOP or HELP requests, may not be received, and we will not be liable for honoring requests made in such messages.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the service, any errors in such information, and/or any action you may or may not take in reliance on the information or service.
